Terms and conditions for export business

1. Prices and charges:
The quoted prices are net in EUR. If the customer is based in a European Union country, the statutory value added tax will be levied, unless the customer has a sales tax identification number exempting that company from German V.A.T. or the delivery of goods is outside the European Union. The manufacturer reserves the right to alter the prices at any time. A transaction charge of EUR 85.-- for export papers and EUR 45,-- for bank charges per order will be made for all foreign transactions.

2. Delivery conditions:
Deliveries shall be made ex works and at the earliest possible date. Transport and insurance shall be charged to the recipient. Standard packaging is calculated in the total cost price, special packing is at cost. For foreign orders, the recipient shall bear all import costs and duties. Return of goods shall be agreed with BIOTEC-FISCHER beforehand and made free to Reiskirchen. An itemized list of products, model numbers, and invoice numbers of pro-ducts to be returned is required. All approved returns are subject to a 20% restocking charge.

3. Payment terms:
Unless agreed otherwise, payment for export orders shall be made in advance or by irrevocable letter of credit, to be confirmed by the SGZ Bank Frankfurt on presentation of the usual dispatch documentation to SGZ Bank. The SGZ bank charges shall be borne by BIOTEC-FISCHER, all other costs being charged to the purchaser.

4. Applicable regulations:
The goods shall remain the property of BIOTEC-FISCHER until full payment has been made. For export orders within the European Union, the Law of the Federal Republic of Germany shall apply, enacted and enforceable in Giessen. BIOTEC-FISCHER is further entitled to take action in the locality of the purchaser's head office. This is specially applicable for all other countries outside the European Union.

5. Guarantee:
All products are covered by the company's guarantee against manufacturing defects. The liability of BIO-TEC-FISCHER is limited to repair or replacement of defective goods. This guarantee does not apply to any product or part which (1) is normally consumed in operation or (2) has a nor-mal life inherently shorter than the warranty stated. No other remedy shall be available to the purchaser. In no event shall BIOTEC-FISCHER be liable for spe-cial, indirect, incidental or consequential damages, nor for any da-mages arising out of delay in shipment or pro-duction as well as use in the products.

6. Product changes:
BIOTEC-FISCHER reserves the right to make changes to products without prior notice. BIOTEC-FISCHER is under no obligation to make similar changes in its products pre-viously produced.
